ofcourse a very good news...but at the same time if VB for next month is disappointing , what will be next plan of action.. to have SkILL bill or any way to have interim bills passed?
i don't think its good news ,the failing of the bill just proves that the congress is still xenophobic(or only responsive to the xenophobic anti immi's) if the bill was to legalise 12M brits or other whites it would have sailed through..thats a fact and that speaks alot about this society we live in, coming to legal immi, u think they care? Sessions n all will be as venomous when it comes down to legal, they just used it as an excuse to clobber illegal immi , if he really cared he would not have obstructed the SKIL in dec 2006, its gonna get worse coz now the anti immi's have grown in strength and confidence , no bill helping legal immi is ever gonna pass, they might increase the h1b's a lil bit but will introduce tons of h1b/L1 killers so forget anything thats gonna help anybody in here now be it GC retro or whatever,

Since AILF has already issued a preliminary notice about a class action law suit if USCIS rejects applications under a revised bulletin this is a preliminary poll on how many of us would join the law suit? I for one will join the law suit. Understand that you will have to reveal all details about yourself and application in the lawsuit and those details will be transparent to DOS and USCIS.

I just spoke to my lawyer. We are considering another point that my high schooling is for 13 years, so if we highlight that in evaluation along with 3 years Bachelor then it might serve the purpose.
USCIS accepts 3 years Bachelor from UK and New Zeland as equivelent to US 4 years, cuz these countries have 13 years high schooling. In my case due to my 3 years diploma(polytechnic) before bachelor, make my 13 years high schooling. Still exploring different points.
Have anyone earlier faced this scenerio? if yes, please share the possibilities.

I don't know how to explain this in any sensible way without sounding like a nitpicking pedand (but I can't just "not say it"), but my point about the "DOF is always the same for the same framing", was particularly to point out that wide-angle lenses are good for close-to-subject-and-crop, but it does NOT magically give you different focusing or DOF behaviour - it's still the same for the same framing of the subject.
Depending on the layout of the house, using a longer focal range can actually help - there is less rotation of the camera, and that means less change in distance to the subject, meaning that it's easier to get the focus - but that assumes large open areas in the house, which doesn't work well in some situations (my house has no place where you can see much more than about 15 feet in a straight line). It has an added advantage of "you stand further away, so you don't disturb the children quite so much".

I just received this RFE on my spouse's I-485 application. It states that while the applicant's name is spelt **i**** on the application it is spelt **ee**** on the birth and marriage registration certificate. The RFE states that they require some sort of document to show that name was officially changed. In a following note the RFE states that the document (I would assume the green card) that the USCIS will issue will be issued in the name on the birth certificate instead of on I-485 application if sufficient proof of registration of name change is not provided. Only a copy of the passport will not be treated as sufficient proof and supporting documentation that the name was registered with authority has to be provided for the USCIS to accept the name change.
Did anyone face this type of issue. What did you do. Any information would be appreciated as I have no clue about how to deal with this. I will ofcourse consult a lawyer at the beginning of next week but would like some advice.

well I wouldn't classify any company as good or bad, i've only gone to one company and have been with them since 05 and have no issues so far. They have provided me with everything that i needed and have so far been very professional.
I'm not sure if I'm allowed to write company specific information on the forum, so I'll refrain from that. But if you like any specifics you can drop me a PM. Heres what my company offers:
* NO Contracts / Bond what-so-ever.
* I get to choose my own rates (if i get my own contract that is, and i have so far)
* There is a 60:40 ratio. 60 i keep and 40 they keep. - Before taxes of course.(You might think this is high, but it's worthwhile cos i get no headaches)
* I get PPO Blue Cross Blue Shield Medical coverage for me and my wife.
* Upto $1000 in dental coverage in a year, reimbursed.
* Direct contact with the lawyer and i can pay him directly any immigration related fees, or opt to take a fraction off my paycheck. (Hence i know the actual cost and i know they are not charging any overhead costs)
* Direct deposit guaranteed at the end of the month even though they haven't received the payment as yet.
* I can leave them when ever i want, no questions asked nothing.
* If you are with them and you get your spouse in, they will offer up to 80:20 ratio and same benefits.
CONS:
====
* No training, in any related fields.
* You have to find your own contract (although they have affiliations with head hunters who would help in getting u a contract)
* Haven't ever spoken about on-bench pay... but i figure they will pay min for a month if need be.
At first i thought the ratio was too high and was looking to switch, and at the same time my wife was getting her H1B. A company NJ offered her a ratio of 70:30 and min benefits, plus a 1 year contract of which if breached would cost us 20K.
After she got her H1B and $2,500 in legal fees, they changed their minds, and was willing to pay only a fixed pay of 55K. I waited till she finished her training, and said screw you, gave em the finger.
She's now working with my company, and making 97K with a 80:20 ratio. Almost 20K more than me! lol.:eek:
In a nutshell i would watch out for the following no matter which company you choose.
* Make sure you cover all grounds with them 1st.
* Get everything in writing before anything. (In my case the first time it worked out fine, cos 60:40 was a high ratio but they offered all the benefits and no hassle.)
* Make sure you have access to the lawyer directly.
* Always go for a ratio basis, the more you are billed the more you earn, and it motivates you.

Hello,
I graduated with a MS degree and I had 4 years of experience (on H1B) as a Test Engineer. I changed the job to a Software Engineer after 4 years. I am now applying for my labor certification for EB2 category. Do I have to apply as MS + 4 years of experience as a Test Engineer position only? (Since my past experience is as a Test Engineer?) OR Can I apply MS + 0 years of experience as a Software Engineer?
Or is there any other combination, that would help approve labor in EB2?
I am aware about the "MS degree requirement" in the position requirements for the case to qualify in the EB2 category and the employer is willing to do that.

The bigger problem is that your parents visa has already been rejected twice and that would be in their database. And that was when your parents were working. Now they are also retired which also adds another complication since the visa officers look to see if the people who a asking for a visitors visa have anything left in India to come back to ( like real estate , good bank balances , jobs , family etc )
I don't think it matters much if you are sponsering them or they are paying for it themselves.. its the twice visa denial in past that might be the key.

Hey, me and my spouse's case also received by NSC on 8/15. Both our EAD status is "Case pending and received". What were your dates? Mine were:
EAD recieved 8/15 notice date 10/11 from NSC.

DialogAddTo.RestoreDirectory = true;
added that line before .showDialog() and it fixed the problem...
